Content that infringes or violates any right of a third party including: copyright, patent, trademark, trade secret or other proprietary or contractual rights or rights of privacy (specifically, you must not distribute another person's personal information of any kind without their express permission) or publicity; or any confidentiality obligation;

Content that is considered commercial, business-related or advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations);

Public Forums And Communcations

Please note that, at all times, you, as a registered user, are responsible for updating your personal information to provide www.racefans.biz with your current e-mail address.

In the event that the last e-mail address that you have provided is not valid, or for any other reason is not capable of delivering to you the notice described above, the dispatch of the e-mail by www.racefans.biz containing such notice will nonetheless constitute effective notice of any amendment described in the notice.

Any and all such amendments to these terms of use will be effective fifteen (15) business days following either dispatch of e-mail notices to registered users or the posting of the notice of changes in the community sections of www.racefans.biz.

General Provisions

These terms of use shall be governed by and construed in accordance with the laws of the State of Alabama and the laws of the United States, without giving effect to any principles of conflicts of law.

If any provision of these terms of use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.

No waiver of any provision of these terms of use by www,racefans.biz shall be deemed a further or continuing waiver of such provision or any other provision, and the failure of www.racefans.biz to assert any right or provision under these terms of use shall not constitute a waiver of such right or provision.

You agree that any cause of action you may have arising out of or related to these Terms of Use or the www.racefans.biz site must commence within one (1) year after cause of action accrues; otherwise, such cause of action must be dismissed.
